1. Acceptance of Terms

By downloading, installing, or using the There & Back mobile application (“There & Back”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use the App.

2. App Description

There & Back is a comprehensive camping and travel companion app designed for Australian adventurers. The App provides access to campgrounds, points of interest, trip planning tools, and community features. The App offers both free and premium subscription-based features.

3. Subscription Terms & Auto-Renewable Subscriptions

3.1 Premium Monthly Subscription Details
  • Subscription Name: Premium Monthly Subscription
  • Duration: 1 Month (30 days)
  • Price: $2.95 AUD per month
  • Billing Cycle: Monthly, automatically renewed
3.2 Auto-Renewal & Billing
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • Payment will be charged to your iTunes Account (iOS) or Google Play account (Android) at confirmation of purchase
  • You can manage and cancel subscriptions by going to your Account Settings in the App Store (iOS) or Google Play Store (Android) after purchase
3.3 Subscription Management & Cancellation

To cancel your subscription:

  • iOS Users: Go to Settings → Apple ID → Subscriptions → There & Back → Cancel Subscription
  • Android Users: Go to Google Play Store → Account → Subscriptions → There & Back → Cancel

No cancellation of the current subscription is allowed during the active subscription period. Cancellation takes effect at the end of the current billing cycle.

3.4 Free Trial (when applicable)

If a free trial is offered, any unused portion of the free trial period will be forfeited when you purchase a subscription to that publication.

4. Eligibility

You must be at least 18 years old, or have parental/guardian consent, to use the App. By using the App, you warrant that you meet these requirements.

5. Permitted Use of the App

  • You agree to use the App for lawful purposes only
  • You must not misuse, hack, or interfere with the operation of the App
  • You must not upload illegal, harmful, or inappropriate content
  • You must respect other users and the camping community
  • We may suspend or terminate access if these Terms are breached

6. User Accounts and Security

  • You are responsible for maintaining the confidentiality of your login details
  • You must notify us immediately of any unauthorised use of your account
  • You are responsible for all activities that occur under your account

7. Payment Terms

  • All payments are processed through the Apple App Store or Google Play Store
  • Prices are displayed in Australian Dollars (AUD) unless otherwise stated
  • We do not store or process payment information directly
  • Refunds are subject to Apple’s and Google’s respective refund policies
  • Price changes will be communicated in advance

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and handling of your personal data as outlined in our Privacy Policy.

9. Camera and Location Access

The App may request access to your device’s camera and location services for features such as:

  • Uploading photos to your trip diary
  • Adding images to campground reviews
  • GPS navigation and trip tracking
  • Finding nearby campgrounds and points of interest

You may disable these permissions in your device settings, but some features may not function without them.

10. User-Generated Content

  • You retain ownership of content you create (photos, reviews, diary entries)
  • By posting content, you grant us a license to use, display, and distribute it within the App
  • You must not post content that violates others’ rights or is inappropriate
  • We reserve the right to remove content that violates these Terms

11. Intellectual Property

  • All App content, trademarks, and software are owned by CGBC Holdings Pty Ltd or our licensors
  • You are granted a limited, non-exclusive, non-transferable licence to use the App
  • You may not copy, modify, or distribute our proprietary content

12. Prohibited Activities

You may not use the App to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Harass, abuse, or harm other users
  • Distribute spam or malicious content
  • Attempt to gain unauthorized access to our systems
  • Use the App for commercial purposes without permission

13. Disclaimer and Limitation of Liability

Important: Camping and travel activities involve inherent risks. We provide information as-is and recommend verifying details independently.

  • To the maximum extent permitted by law, we are not liable for any loss, damage, or claims arising from your use of the App
  • We do not guarantee the accuracy of campground information or user reviews
  • Australian Consumer Law rights remain unaffected
  • Use the App’s navigation features as a guide only – always carry physical maps and safety equipment

14. Termination

We may suspend or terminate your access to the App at any time without notice if you breach these Terms. Upon termination, your right to use the App ceases immediately.

15. International Use

  • The App is designed primarily for use within Australia
  • If you access the App outside Australia, you are responsible for complying with local laws
  • We make no representation that the App is appropriate or available in all locations

16. Governing Law

These Terms are governed by the laws of Australia, specifically New South Wales, without regard to conflict of law provisions. Any disputes will be subject to the jurisdiction of Australian courts.

17. Changes to Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. We will notify users of material changes through the App or via email. Continued use of the App after changes means you accept the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

For iOS users downloading from the Apple App Store:

  • These Terms are between you and CGBC Holdings Pty Ltd, not Apple
  • Apple is not responsible for the App or its content

  • Apple acts as agent for the sale of subscriptions
